Regulation updating the Decree issued by the Minister for Health of 21 March 1973, concerning: ‘Hygienic packaging, containers and tools intended to come into contact with foodstuffs or with substances for personal use’, limited to stainless steels.

The provisions set out in the notified draft regulation concern the inclusion of new stainless steels in the positive list in Annex II - section 6 of the Ministerial Decree of 21 March 1973. One steel is included in part A (stainless steels identified by abbreviations provided for in European or international standards) and the other in part B (steels identified by chemical analysis of castings, in the absence of abbreviations provided for in European or international standards).
Brief Statement of Grounds: The issuing of this regulation is necessary in order to update the positive list of stainless steels authorised for the manufacture of objects intended for food contact, following documented requests from companies in the sector.
Article 1
1.Annex II, Section 6: ‘Stainless steels’ of the Decree of the Minister for Health of 21 March 1973, as amended, is replaced by Annex 1 to this Decree.
Article 2
1. The provisions pursuant to previous Articles are not applicable to stainless steel legally manufactured and/or sold in a Member State of the European Union or in Turkey, namely legally manufactured in one of the States that has signed the European Free Trade Association (EFTA), contracting party to the European Economic Area (EEA), provided it guarantees an equivalent level of protection for health.
